New York Enforces Responsible Gambling Ads in Sports Betting

New York Governor Kathy Hochul has signed new legislation aimed at strengthening responsible gambling messaging in sports betting advertising. The bill, signed on October 1, builds on existing regulations by requiring all gambling and sports betting ads to feature clear warnings about the potential harmful and addictive effects of gambling.

Previously, advertising for online sports betting was not explicitly covered by state law, though it was subject to the New York State Gaming Commission’s rules on responsible gambling.

“Protecting New Yorkers from the dangerous and addictive effects of problem gambling and sports betting is vitally important for the prosperity of our great State,” said Governor Hochul.

“I want New Yorkers to be able to safely enjoy the activities they love, while proceeding with caution when necessary. I’m confident that with the signing of this new bill, New Yorkers will have easier access to the safety resources they need to better protect themselves from the grips of addiction.”

The legislation, known as S1550/A1118, not only mandates responsible gambling messaging in ads but also requires the State Gaming Commission to collaborate with the Commissioner of Addiction Services and Supports. This cooperation ensures that all gaming advertisements include a problem gambling hotline number for those seeking help.

New York Senator Leroy Comrie emphasized the importance of this legislation:

“New York residents have access to various gambling options, including casinos, racetracks, the lottery, and sports betting platforms like FanDuel and DraftKings. It’s essential that users are informed about the risks of addiction and know where to seek help if needed.”

Comrie added that while state revenue is important, promoting responsible gambling and safeguarding communities is a critical priority. He thanked Assemblymember Clyde Vanel for working alongside him to pass the bill and Governor Hochul for enacting it into law.

Brian O’Dwyer, Chair of the New York State Gaming Commission, praised the move:

“New York State recognizes the importance of responsible gaming practices and has strong safeguards in place to protect and educate bettors. By signing this bill, Governor Hochul continues to deliver smart and responsible gaming policies that help support our State.”
