Ireland Approves Gambling Regulation Bill

This landmark legislation creates Údarás Rialála Cearrbhachais na hÉireann, the Gambling Regulatory Authority of Ireland (GRAI), and introduces a comprehensive regulatory framework for both online and in-person gambling.

Ireland Approves Gambling Regulation Bill

James Browne TD, Minister of State for Law Reform at the Department of Justice, has welcomed the successful passage of the Gambling Regulation Bill 2022 through both Houses of the Oireachtas. This landmark legislation creates Údarás Rialála Cearrbhachais na hÉireann, the Gambling Regulatory Authority of Ireland (GRAI), and introduces a comprehensive regulatory framework for both online and in-person gambling.

Key provisions of the Bill include the establishment of a National Gambling Exclusion Register, new regulations on gambling advertising, and the creation of a Social Impact Fund to support education and treatment related to problem gambling. It also introduces strong measures to combat black market operators and includes penalties such as custodial sentences for unlicensed gambling violations.

Minister Browne expressed his satisfaction with the Bill’s passage, noting the extensive effort involved:

“I am delighted to see the passage of this long-anticipated legislation, the result of tireless efforts by myself and a dedicated team of officials. This Bill establishes a simplified and coherent licensing framework that reflects modern gambling practices, especially given the rise of digital gambling and advertising."

He added that the legislation is primarily a public health initiative, designed to protect vulnerable groups from gambling-related harm. Once operational, the GRAI will enforce compliance with its new licensing regulations, backed by enforcement powers.

Extensive consultations informed the Bill, including input from industry representatives, charities, and experts on problem gambling. A study conducted by the ESRI also contributed to shaping the Bill’s approach. Anne Marie Caulfield, the appointed CEO Designate of GRAI, is leading operational preparations alongside a Programme Board within the Department of Justice.

Caulfield commented on the Bill’s significance:

“The passage of the Gambling Regulation Bill is a major milestone in establishing the Gambling Regulatory Authority of Ireland. Our phased rollout will begin with a focus on licensing, ensuring that operators comply with the new framework while addressing problem gambling."

The Bill also funds research and initiatives addressing gambling harm, supported by the Social Impact Fund. As part of Budget 2025, the GRAI will receive €9.1 million, including €4 million for ICT investments.

Minister Browne added, “This Bill balances the freedom to gamble with safeguards against addiction, providing clarity for both operators and consumers."

He also commended Ms. Caulfield’s leadership in preparing for the Authority’s establishment, which has already seen €3.337 million in spending by the end of September 2024.
