Stake Brasil Secures Court Injunction Protecting Betting Licence Amid Regulatory Dispute
Stake Brasil has secured a preliminary injunction temporarily preserving its betting authorisation and preventing restrictions on its operations as it challenges the implications of Provisional Measure 1,394/2026.

Stake Brasil has secured a partial preliminary injunction from the 9th Federal Civil Court of São Paulo, temporarily protecting its betting authorisation following the introduction of Provisional Measure (MP) 1,394/2026.
The ruling allows the operator to continue operating under its existing authorisation until 25 October 2026 while its legal challenge progresses.
Under the decision, Stake Brasil’s authorisation remains valid and its Brazilian betting platform, stake.bet.br, cannot be blocked or redirected. The injunction also prevents sanctions being imposed on the operator for activities conducted within the conditions established by the court.
The ruling is preliminary and does not represent a final determination of the wider legal challenge.
Stake Brasil Welcomes Court Decision
Stake Brasil welcomed the decision, arguing that it provides recognition of the legal position of operators that have met the requirements for obtaining authorisation.
The operator said:
“Stake Brasil positively receives the decision of the Federal Court of São Paulo, which provisionally preserved the effects of its authorization for the exploration of fixed-odds betting.
“The decision represents an important signal for Stake Brasil and for all those who operate under state authorization and supervision.
“By recognizing that an authorization obtained by fulfilling all legal requirements, paying the grant fee, and making significant investments confers a legal position that cannot be suppressed without due consideration, the Court reaffirmed the importance of legal certainty and the stability of rules.”
Operator Highlights Consumer Protection
Stake Brasil also highlighted the relationship between regulatory certainty and consumer protection, arguing that regulated markets depend on clear requirements, responsible gambling measures and oversight from public authorities.
The statement continued:
“Stake Brasil understands that consumer protection is one of the main benefits of a regulated market. It is in this environment, with clear rules, responsible gaming mechanisms, and public authority oversight, that this protection becomes effective.
“Since the publication of the Provisional Measure, Stake Brasil has fully complied with the imposed obligations and will continue to do so, in relation to the Provisional Measure and the determinations of the Judiciary, remaining at the disposal of the authorities.
“To our knowledge, we are the first licensed operator to get a decision of this kind.”
Wider Legal Questions Remain Unresolved
The injunction applies specifically to Stake Brasil and provides temporary protection against disruption to its authorised activities.
The operator’s claim that it is the first licensed company to obtain such a decision could also draw attention from other operators assessing the impact of MP 1,394/2026 on existing authorisations.
However, the preliminary nature of the ruling means the broader legal questions surrounding the measure and its effect on licensed operators remain unresolved.
With the current protections in place until 25 October 2026, further judicial developments will determine whether Stake Brasil secures longer-term protection for its operating authorisation.
